Repudiation of Special Condition 17 of Contracts of Sale of properties 4, 8, 13, 17 and 19 Chapman Street, Strathfield by City of Canada Bay Council to Arinson Pty Ltd dated 30 June 2000.
Following the decision of Justice Biscoe in Land & Environment Court Proceedings 40171 of 2007, City of Canada Bay Council & Others ats F&D Bonnacorso, Council has resolved at its meeting of 2 October 2007 as follows:
| | THAT Council repudiate Special Condition 17 as contained within Contract for Sale dated 30 June 2000 between Concord Council and Arinson Pty Ltd in respect of properties 4, 8, 13, 17 and 19 Chapman Street, Strathfield. THAT this decision be notified in the local press and on Council's website. THAT the owners of the subject land be notified of the decision in writing. THAT Council will not include a similar clause in future contracts for any sales of its land.

Special Condition 17 stated the following:
| | Demolition of Improvements The Council agrees, as consent authority, to accept and approve an application for the demolition of all or any of the properties comprised in this contract subject to conditions as it may reasonably impose in accordance with its usual practice when approving such applications. The purchaser acknowledges that should such approval be forthcoming prior to completion of the purchase of any of the properties herein, it shall not be entitled to carry out any demolition works on a property until it has completed the purchase of such property. This clause shall not merge on completion. | |
