Register of Donations and Expenditure Declarations

Section 328A of the Local Government Act 1993 which comes into effect from September 1, 2008 provides that Council must keep a public register of all current donations and expenditure declarations lodged by Councillors with the Election Funding Authority (EFA). The Department of Local Government has advised that the following link to the Election Funding Authority website will satisfy the requirements of Section 328A:

Members of the public who wish to obtain printed copies of disclosures of political donations may obtain these from the EFA website, or by requesting copies from Council via an Access to Information request.

Disclosure of Political Donations or Gifts relating to relevant Planning Decisions

In October 2008 legislation came into effect requiring Councils disclose all information relating to political donations and gifts for relevant planning applications when lodging an application or making a submission. The declaration is to be made to Council at the time of lodgment of an application, or when making the submission (either and objection of in support).

A relevant planning application includes an application for development consent under Part 4 of the Environmental Planning and Assessment Act 1979.

When donations or gifts must be declared, the Political Donations Gift Disclosure Statement Form must be completed in full and lodged with the application or submission.

Register of Government Contracts

In accordance with Section 27 of the Government Information (Public Access) Act 2009, Council is required to maintain a register that records information about  each government contract which has (or is likely to have) a value of $150,000 or more and can be considered a class 1 contract.

Register of Planning Decisions at Council Meetings 

Section 375A of the Local Government Act 1993 requires the General Manager to establish and maintain a register, of all Development Applications and Planning Decisions made by Council, which is available to the public. The registers, listed for each month, contain a description of the development or planning matter, the decision that was made, the Councillors who voted in favour, and the Councillors who opposed.
